Acceptance of Terms

Welcome to PeekPosting. These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and PeekPosting Ltd. ("PeekPosting", "we", "us", "our"), governing your access to and use of the PeekPosting social media automation platform, including our website, applications, and all related services (collectively, the "Service").

By accessing or using our Service, creating an account, or clicking "I Accept" or similar buttons, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our Service.

Important Notice: These Terms include provisions that limit our liability, require arbitration for dispute resolution, and affect your legal rights. Please read them carefully before using our Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this binding agreement.

Section 2

Service Description

PeekPosting provides a comprehensive social media automation platform designed for commercial use by businesses, organizations, and professional content creators. Our Service enables users to:

  • Schedule and publish content across multiple social media platforms automatically
  • Manage multiple social media accounts from a centralized dashboard
  • Analyze performance metrics and engagement data across connected platforms
  • Collaborate with team members on content creation and approval workflows
  • Generate AI-powered content suggestions and captions (available on select plans)
  • Access advanced analytics and reporting tools to optimize social media strategy

2.1 Service Availability

We strive to maintain 99.9% uptime for our Service, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our reasonable control. We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time with or without notice.

2.2 Service Limitations

Each subscription plan includes specific limitations on the number of posts, connected accounts, team members, and features available. These limitations are clearly outlined in your selected plan and may be subject to change. Exceeding your plan's limitations may result in additional charges or service interruptions.

2.3 Beta Features

We may occasionally offer beta or experimental features. These features are provided "as is" and may not function as intended. We may discontinue beta features at any time without notice or liability.

Section 3

User Accounts & Registration

To access certain features of our Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.1 Account Requirements

When registering for an account, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Provide accurate and truthful information, including a valid email address
  • Maintain and promptly update your account information to keep it accurate and current
  • Create a strong, secure password and not share it with any third party
  • Not create an account using false information or on behalf of someone else without permission
  • Not create multiple accounts for the purpose of circumventing plan limitations or restrictions

3.2 Account Security

You are solely responsible for safeguarding your account credentials and must immediately notify us of any unauthorized access to or use of your account. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

3.3 Commercial Use Restriction

Our Service is intended exclusively for commercial business purposes. By creating an account, you represent that you are using the Service for lawful business activities, including but not limited to marketing, brand promotion, customer engagement, and professional content creation.

3.4 Account Verification

We may require you to verify your email address, phone number, or business information before accessing certain features. Failure to complete verification when requested may result in limited or suspended access to the Service.

Section 4

Subscription & Payment Terms

PeekPosting operates on a subscription-based pricing model. By subscribing to any of our plans, you agree to pay all applicable fees and charges according to the pricing and payment terms in effect at the time.

4.1 Subscription Plans

We currently offer the following subscription tiers:

  • Basic Plan - $20/month: 20 posts per month, basic analytics
  • Business Plan - $40/month: 30 posts per month, advanced analytics, AI caption suggestions
  • Content Creator Plan - $60/month: Unlimited posts, white label, advanced analytics, AI suggestions, priority support, team collaboration.

All prices are stated in US Dollars (USD) and exclude applicable taxes unless otherwise specified. You are responsible for paying all taxes associated with your use of the Service.

4.2 Free Trial

We may offer a 14-day free trial period for new users. During the trial period, you will have access to features according to the plan you selected. You will not be charged until the trial period ends. To avoid being charged, you must cancel your subscription before the trial period expires.

Free trials are limited to one per user and per business entity. We reserve the right to determine eligibility for free trials and may deny trials to users who have previously used our Service or who we suspect of fraudulent activity.

4.3 Billing & Automatic Renewal

Subscriptions are billed on a monthly basis in advance. By subscribing, you authorize us to charge your designated payment method automatically on each renewal date. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

If your payment method fails or your account is past due, we reserve the right to suspend or terminate your access to the Service until payment is received. You remain responsible for any uncollected amounts.

4.4 Price Changes

We reserve the right to modify our pricing at any time. Price changes will take effect at the start of your next billing cycle after we provide you with at least 30 days' advance notice. Your continued use of the Service after a price change constitutes your acceptance of the new pricing.

4.5 Refunds & Cancellation

All subscription fees are non-refundable except as required by law or as explicitly stated in these Terms. You may cancel your subscription at any time, but you will not receive a refund for any unused portion of your subscription period. Upon cancellation, you will retain access to the Service until the end of your current billing period.

To cancel your subscription, you must follow the cancellation process outlined in your account settings or contact our support team.

4.6 Overages & Additional Charges

If you exceed the limitations of your subscription plan (such as the number of scheduled posts), we may charge additional fees, throttle your service, or require you to upgrade to a higher-tier plan. We will make reasonable efforts to notify you before charging overage fees.

Section 5

Acceptable Use Policy

Your use of the Service must comply with all applicable laws, regulations, and these Terms. You are solely responsible for all content you create, upload, schedule, or publish through our Service.

5.1 Prohibited Activities

You agree NOT to use the Service to:

  • Violate any local, national, or international law or regulation
  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Infringe upon the intellectual property rights, privacy rights, or other rights of any third party
  • Impersonate any person or entity or falsely represent your affiliation with any person or entity
  • Engage in spamming, mass unsolicited messaging, or any form of commercial solicitation that violates platform policies
  • Post content that contains viruses, malware, or any harmful code
  • Attempt to gain unauthorized access to our systems, other users' accounts, or connected social media platforms
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use automated systems (bots, scripts) to create accounts or interact with the Service in ways not expressly authorized
  • Scrape, data mine, or extract data from the Service without our express written permission
  • Resell, redistribute, or provide access to the Service to any third party without our authorization
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Remove, obscure, or alter any proprietary notices on the Service

5.2 Content Standards

While we do not pre-screen content scheduled through our Service, all content must comply with the terms of service and community guidelines of the respective social media platforms where it will be published. This includes but is not limited to Facebook, Instagram, Twitter/X, LinkedIn, TikTok, and YouTube.

You are responsible for ensuring that your content does not violate third-party platform policies. PeekPosting is not responsible for content removal, account suspension, or bans imposed by third-party platforms.

5.3 Compliance with Platform Policies

You must comply with all applicable policies of third-party social media platforms you connect to PeekPosting. Violations of platform policies may result in the suspension or termination of your PeekPosting account in addition to any actions taken by the third-party platforms.

5.4 Enforcement

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this Acceptable Use Policy, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

Section 6

Content & Intellectual Property

6.1 Your Content

You retain all ownership rights to the content you create, upload, or schedule through our Service ("User Content"). By using our Service, you grant PeekPosting a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content solely for the purpose of providing and improving the Service.

This license exists only for the duration of your use of the Service and for a reasonable period thereafter as necessary to fulfill any outstanding scheduled posts. We will not use your User Content for any purpose other than providing the Service unless we obtain your explicit consent.

6.2 Content Responsibilities

You represent and warrant that:

  • You own or have obtained all necessary rights, licenses, and permissions to use and authorize us to use your User Content
  • Your User Content does not and will not infringe, violate, or misappropriate any third-party intellectual property rights
  • Your User Content complies with all applicable laws and these Terms
  • You have obtained all necessary consents, releases, and permissions from any individuals appearing in your User Content

6.3 PeekPosting's Intellectual Property

The Service, including its original content, features, functionality, design, logos, trademarks, and all related intellectual property rights, is and will remain the exclusive property of PeekPosting and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business purposes in accordance with these Terms. This license does not include any resale or commercial use of the Service or its contents, or any derivative use of the Service or its contents.

6.4 AI-Generated Content

For plans that include AI-powered caption suggestions and content generation, you acknowledge that AI-generated content is provided as a suggestion only. You are responsible for reviewing, editing, and approving all AI-generated content before publication. We do not guarantee the accuracy, appropriateness, or originality of AI-generated content.

6.5 Copyright Infringement Claims

We respect intellectual property rights and expect our users to do the same. If you believe that your copyrighted work has been used through our Service in a way that constitutes copyright infringement, please provide our designated copyright agent with the following information in accordance with the Digital Millennium Copyright Act (DMCA):

  • A physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the infringing material and information sufficient to locate it
  • Your contact information (address, telephone number, email address)
  • A statement that you have a good faith belief that the use is not authorized
  • A statement made under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner

Data Protection & Privacy

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of personal data as outlined in our Privacy Policy.

7.1 GDPR Compliance

For users located in the European Economic Area (EEA), United Kingdom, or Switzerland, we process your personal data in compliance with the General Data Protection Regulation (GDPR) and applicable data protection laws. You have the following rights regarding your personal data:

  • Right of Access: You can request access to your personal data
  • Right to Rectification: You can request correction of inaccurate personal data
  • Right to Erasure: You can request deletion of your personal data ("right to be forgotten")
  • Right to Restriction: You can request restriction of processing under certain circumstances
  • Right to Data Portability: You can request a copy of your data in a structured, machine-readable format

7.2 Data Storage & Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

Your data may be stored on servers located in various jurisdictions. By using the Service, you consent to the transfer of your data to these locations.

7.3 Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. Upon account termination, we will delete or anonymize your personal data within 90 days, except where retention is required by law.

7.4 Social Media Platform Access

When you connect social media accounts to PeekPosting, you grant us access to certain information from those platforms in accordance with their respective privacy policies and authorization processes. We only access the minimum information necessary to provide our Service, which typically includes:

  • Account profile information
  • Publishing permissions to post on your behalf
  • Analytics and engagement metrics
  • Follower/audience data (aggregate only)

You can revoke PeekPosting's access to your social media accounts at any time through your platform settings or by disconnecting the account within PeekPosting.

Section 8

Third-Party Platform Integration

PeekPosting integrates with various third-party social media platforms and services to provide our core functionality. Your use of these integrations is subject to both these Terms and the respective terms of service of each third-party platform.

8.1 Platform Dependencies

Our Service's ability to publish content and retrieve analytics depends on third-party platform APIs and access permissions. Changes to platform APIs, policies, or access restrictions may affect the functionality of our Service. We are not responsible for disruptions, limitations, or changes imposed by third-party platforms.

Supported platforms currently include (but are not limited to):

  • Facebook & Instagram (Meta Platforms)
  • TikTok
  • YouTube
  • Klapp.app (Content Creator Plan only)

The availability of specific platforms and features may vary by subscription plan and geographic location.

8.2 Platform Compliance

You are responsible for ensuring that your use of PeekPosting and the content you publish complies with the terms of service, community guidelines, and policies of all connected platforms. Platform violations may result in:

  • Content removal by the platform
  • Account suspension or ban on the platform
  • Loss of posting permissions
  • Suspension or termination of your PeekPosting account

8.3 No Platform Affiliation

PeekPosting is an independent service and is not affiliated with, endorsed by, or sponsored by any of the social media platforms we integrate with. All product names, logos, and brands are property of their respective owners.

8.4 Rate Limits & Restrictions

Third-party platforms impose rate limits and posting restrictions that may affect your ability to publish content through PeekPosting. We implement reasonable measures to comply with these limits, but we cannot guarantee that all scheduled posts will be published exactly as scheduled if platform limits are exceeded.

Section 9

Termination & Suspension

9.1 Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or by contacting our support team. Upon termination:

  • Your subscription will remain active until the end of your current billing period
  • You will not receive a refund for any unused portion of your subscription
  • Your scheduled posts will continue to publish until the end of your billing period
  • Your data will be retained for 90 days after account closure to allow for reactivation
  • After 90 days, all your data will be permanently deleted from our systems

9.2 Termination or Suspension by PeekPosting

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to:

  • Breach of these Terms or any applicable law
  • Violation of our Acceptable Use Policy
  • Fraudulent, abusive, or illegal activity
  • Failure to pay applicable fees
  • Prolonged inactivity
  • Requests from law enforcement or government agencies
  • Unexpected technical or security issues
  • Discontinuation or material modification of the Service

9.3 Effect of Termination

Upon termination of your account for any reason:

  • Your right to use the Service will immediately cease
  • All scheduled posts will be canceled and will not be published
  • You will lose access to all content, data, and analytics stored in your account
  • Any outstanding fees owed to PeekPosting will become immediately due and payable
  • We may delete your account data in accordance with our data retention policies

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9.4 Account Reinstatement

If your account is suspended or terminated for non-payment or minor violations, you may request reinstatement by contacting our support team and addressing the violation. We reserve the right to deny reinstatement requests at our sole discretion.

Warranties & Disclaimers

Important Notice: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

10.1 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEEKPOSTING EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • TITLE
  • QUIET ENJOYMENT
  • ACCURACY OF DATA
  • INTEGRATION OR COMPATIBILITY

10.2 No Guarantee of Results

We do not warrant that:

  • The Service will meet your requirements or expectations
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the use of the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • Scheduled posts will be published exactly as scheduled or at all
  • Analytics data will be complete or accurate
  • Third-party platform integrations will function without interruption

10.3 Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by PeekPosting. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that PeekPosting shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

10.4 AI-Generated Content Disclaimer

AI-generated content suggestions are provided as recommendations only and may contain errors, inaccuracies, or inappropriate content. You are solely responsible for reviewing and approving all AI-generated content before publication. We make no warranties regarding the quality, accuracy, originality, or suitability of AI-generated content.

10.5 Use at Your Own Risk

Your use of the Service is at your sole risk. Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

Limitation of Liability

Critical Limitation: This section limits PeekPosting's liability to you. Please read carefully.

11.1 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEEKPOSTING, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • LOSS OF PROFITS, REVENUE, OR BUSINESS
  • LOSS OF DATA OR CONTENT
  • LOSS OF GOODWILL OR REPUTATION
  • COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES
  • INTERRUPTION OF BUSINESS
  • DAMAGE TO SOCIAL MEDIA ACCOUNTS OR ONLINE REPUTATION
  • ANY OTHER COMMERCIAL DAMAGES OR LOSSES

This limitation applies whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, whether or not PeekPosting has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

11.2 Maximum Liability Cap

IN NO EVENT SHALL PEEKPOSTING'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF:

  • THE TOTAL AMOUNT PAID BY YOU TO PEEKPOSTING IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR
  • ONE HUNDRED EUROS (€100)

11.3 Exceptions

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, PeekPosting's liability shall be limited to the maximum extent permitted by law.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under applicable law

11.4 Indemnification

You agree to defend, indemnify, and hold harmless PeekPosting and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use or misuse of the Service
  • Your User Content
  • Your violation of any third-party rights, including intellectual property rights
  • Your violation of any applicable laws or regulations
  • Any claim that your User Content caused damage to a third party

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

Section 12

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide notice by:

  • Posting the updated Terms on our website
  • Sending an email notification to the email address associated with your account
  • Displaying a prominent notice within the Service

Material changes will take effect 30 days after we provide notice, unless otherwise stated. Non-material changes or clarifications will take effect immediately upon posting. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription in accordance with Section 9. It is your responsibility to review these Terms periodically for changes. The "Last Updated" date at the top of this page indicates when these Terms were last revised.

We may also modify, suspend, or discontinue any aspect of the Service at any time, including the availability of features, databases, or content. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.

Section 13

Governing Law & Dispute Resolution

13.1 Governing Law

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of [Member State to be specified], without regard to its conflict of law provisions.

For users located in the European Economic Area, United Kingdom, or Switzerland, nothing in these Terms affects your rights as a consumer under mandatory local consumer protection laws.

13.2 Dispute Resolution - Informal Negotiation

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service (collectively, "Dispute"), you agree to first contact us to attempt to resolve the Dispute informally. We will make a good faith effort to resolve the Dispute through informal negotiation within 60 days of receiving notice.

13.3 Arbitration Agreement

If the Dispute cannot be resolved through informal negotiation, you and PeekPosting agree that any Dispute will be resolved through binding arbitration in accordance with the Rules of Arbitration of the International Chamber of Commerce (ICC), except as modified by these Terms.

The arbitration shall be conducted in English and shall take place in [City, Member State to be specified]. The decision of the arbitrator shall be final and binding on both parties. Each party shall bear its own costs and expenses, including legal fees, unless the arbitrator determines otherwise.

Exception: Either party may bring an action in court to enjoin infringement or other misuse of intellectual property rights.

13.4 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PEEKPOSTING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and PeekPosting agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

13.5 Jurisdiction and Venue

If for any reason a Dispute proceeds in court rather than arbitration, both you and PeekPosting agree to submit to the exclusive personal jurisdiction and venue of the courts located in [City, Member State to be specified].

13.6 Consumer Rights

If you are a consumer resident in the European Economic Area, you benefit from mandatory provisions of consumer protection law in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

13.7 Time Limitation on Claims

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred, except where prohibited by applicable consumer protection laws.

14.2 Entire Agreement

These Terms, together with our Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and PeekPosting regarding your use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.

14.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while reflecting the original intent.

14.4 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

14.5 Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent. Any attempted assignment in violation of this section shall be void.

14.6 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

14.7 Relationship of Parties

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and PeekPosting. You have no authority to bind PeekPosting in any manner whatsoever.

14.8 Language

These Terms are written in English. Any translation is provided for your convenience only. In the event of any inconsistency between the English version and any translation, the English version shall prevail.

14.9 Export Control

The Service may be subject to export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and trade and economic sanctions maintained by the U.S. Treasury Department's Office of Foreign Assets Control.

14.10 Survival

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnity obligations, limitations of liability, dispute resolution provisions, and miscellaneous provisions.

Acknowledgment: BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTOOD THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICE.
